You must have a medical condition that prevents you from working and is expected to last at least 12 months or result in death. A diagnosis alone is not enough — you must show the condition makes full-time work impossible. SSDI also requires sufficient work credits; SSI is based on financial need.
There is no fixed list of approved conditions. The Social Security Administration evaluates whether your condition is severe enough to prevent work. Physical conditions, mental health conditions and chronic illnesses can all qualify. What matters is how the condition limits your ability to function.
SSDI is based on your work history and funded through payroll taxes, with payments tied to past earnings. SSI is based on financial need, requires no work history, and pays a fixed monthly amount. The medical rules are identical; the financial rules are completely different.
You can apply on your own, and many people do. The process is complicated, though, and missing information leads to delays or denial. If your case is complex or you have already been denied, representation makes a noticeable difference.
Most initial decisions take several months. If you are denied and must appeal, it can stretch to a year or longer. SSDI benefits also carry a five-month waiting period before payments begin.
File an appeal. Denials are very common, and most initial applications are denied. The process runs through reconsideration, then a hearing before an administrative law judge, then further appeals if needed. This is the stage where legal help matters most.
SSDI is based on your lifetime earnings — the more you paid in, the higher the benefit. SSI pays a fixed federal amount, sometimes supplemented by the state, and is generally lower than SSDI.
There are limits. In general you must not earn more than $1,690 per month if you are not blind, or $2,830 per month if you are blind. Both programs also have work incentive rules that let you test returning to work.
Nothing upfront. Social Security Disability fees are capped by federal law and collected only from your approved back-pay. If your claim is not approved, you pay nothing.
